Terms of Service
These Terms govern business use of AffinityAI, a service provided by Forito Oy, Business ID 2046733-7, Rantapolku 7 A, 00330 Helsinki, Finland. AffinityAI is offered only for business and professional purposes, not to consumers.
1. Agreement structure
The contract consists of these Terms, an accepted Order or checkout, the Privacy Notice and, where applicable, the Data Processing Addendum. An Order controls only where it expressly differs from these Terms.
A person accepting for an organization confirms that they are at least 18 and authorized to bind that organization.
The applicable plan features, usage and participant allowances, organizer allowances, price and billing interval are those presented through the applicable Pricing page, Checkout or order summary, and authenticated Plan or Billing interface. The commercial plan presented at purchase or renewal forms part of the Customer’s agreement.
2. The Service
AffinityAI helps business teams prepare for decisions through structured participant input, AI-supported synthesis and board-ready outputs. AI supports judgment and does not replace professional, legal, financial or other expert advice.
3. Accounts, workspaces and users
Customers are responsible for authorized users, accurate account information and protecting credentials. Workspace administrators control membership and access. Accounts and participant capabilities must not be shared with unauthorized persons.
4. Free and paid plans
A Free plan has no payment card and never converts automatically to a paid subscription. Current allowances and available functions are shown in the applicable commercial presentation and authenticated Plan interface.
When a workspace reaches or exceeds an applicable allowance, AffinityAI may restrict editing, new contributions, reopening, creation, invitations and other operations that increase the affected usage. Existing content remains viewable subject to retention, deletion, security and account-status provisions, and safe usage-reducing operations remain available where authorized.
5. Paid subscriptions and fees
The accepted Pricing page, Order, checkout or Settings → Plan states the price, currency, billing interval, tax treatment and applicable commercial plan. Monthly and annual subscriptions renew automatically.
Forito may update plans and pricing prospectively. Material reductions affecting an existing paid subscription will be communicated appropriately and normally take effect at renewal rather than silently changing an already-paid subscription period. Changes required for law, security, abuse prevention or service integrity may be handled separately under these Terms.
6. Cancellation and refunds
A customer may cancel at any time before renewal is processed, including the day before. Cancellation is recorded immediately, prevents the next renewal and takes effect at the end of the current paid period.
If renewal has already processed, cancellation applies at the end of the newly started period. No prorated refund is promised except where required by law or for Forito’s uncured material breach. Cancellation is not deletion.
7. Customer Content
The Customer owns Customer Content. The Customer grants Forito only the rights needed to operate, secure and support the Service. One customer’s content is never used to improve another customer’s outputs.
Customer Content is not used to train shared or general-purpose AI models unless the Customer separately and explicitly opts in.
8. AI-supported functionality
AI output may be incomplete or inaccurate. The Customer remains responsible for review, decisions and lawful use. Authorized Forito personnel access Customer Content only for requested support, security, incident response or legal compliance.
9. Acceptable use and prohibited data
Do not submit unlawful data, GDPR Article 9 special-category data, Article 10 criminal data, children’s data, payment-card data, passwords, authentication secrets or content the Customer lacks the right to process.
Do not attack, probe, reverse engineer, overload, resell without authorization, evade limits or access another customer’s data.
10. Confidentiality and security
Each party protects the other party’s confidential information with reasonable care. Forito uses appropriate technical and organizational measures and handles personal data as described in the Privacy Notice and DPA.
11. Intellectual property and third parties
Forito retains rights in the Service, software, designs and documentation. Third-party services may have their own terms. Customer feedback may be used without identifying the Customer or disclosing Customer Content.
12. Changes, availability and suspension
The Service may change. Forito may suspend access where reasonably necessary for security, legal compliance, non-payment or material breach, using proportionate measures where practicable.
13. Termination, deletion and retained records
When paid entitlement ends, the workspace downgrades to the currently applicable Free plan. Historical Customer Content is preserved and remains viewable subject to the applicable retention, deletion, security and account-status provisions. Cancellation or downgrade does not itself delete Customer Content.
Where existing usage exceeds the current entitlement, AffinityAI may restrict editing, contributions, reopening, creation, invitations and other limit-increasing operations until usage is reduced or the applicable plan is restored. The Customer may request deletion in accordance with the Privacy Notice, DPA and applicable law. Forito does not promise indefinite retention after account termination or a valid deletion request.
Permanent deletion is asynchronous and ordinarily completes within 30 days after it begins. Content-free deletion evidence may be retained for three years, together with the minimum tombstone needed to prevent restoration or reattachment. Shared company content is not deleted merely because one person leaves.
14. Warranties and disclaimers
The Service is provided as available. To the maximum extent permitted by law, Forito disclaims implied warranties and does not guarantee uninterrupted operation or that AI output will be error-free.
15. Liability
Subject to mandatory law, aggregate liability is capped at fees paid or payable in the preceding 12 months. For claims arising solely from free use, the cap is EUR 100. Nothing excludes liability where exclusion is unlawful, including fraud, wilful misconduct or gross negligence.
16. Changes and notices
Material changes will be notified through the Service or by email. Notices may be sent to the account contact. Where acceptance is required, limit-increasing or commercial actions may be paused until an authorized workspace organizer accepts the updated documents; viewing, cancellation, deletion requests and safe usage-reducing actions remain available.
17. Governing law and disputes
Finnish law governs. The parties first negotiate in good faith for 30 days. Unresolved disputes are finally resolved under the Finland Arbitration Institute combined expedited clause, seated in Helsinki, in English. Urgent interim court relief remains available. Forito may pursue straightforward undisputed payment claims through courts or debt collection.
